Terms of Service

1. Acceptance

By creating an account, joining a session, or using theemsstandard.com (the "Service"), you agree to these Terms. If you use the Service on behalf of an agency or organization, you represent that you are authorized to bind it.

2. What the Service is — and is not

The EMS Standard is a simulation and training platform for EMS and fire-service education. It simulates patient monitors, ventilators, medication kits, and a conversational patient using synthesized waveforms and artificial intelligence.

The Service is not a medical device, is not FDA-cleared, and must never be used for patient care, clinical decision-making, diagnosis, or treatment. Waveforms, vital signs, 12-lead tracings, drug references, and AI output are training artifacts and may differ from real physiology and from your agency's protocols. Your agency's protocols and medical direction always govern.

3. Artificial intelligence

Parts of the Service — the simulated patient's dialogue and voice, scenario generation, protocol-grounded content, and session debriefs — are produced by AI models operated by third-party providers. AI output can be inaccurate, incomplete, or inappropriate. You are responsible for reviewing AI output with a qualified instructor before relying on it for instruction or evaluation. We do not warrant the accuracy of any AI-generated content.

4. No protected health information

The Service is intended for fictional training cases only. You agree not to enter, upload, speak, or record real patient information, including any protected health information under HIPAA or similar laws. We are not a business associate to any covered entity, and the Service is not designed to store PHI.

5. Accounts and plans

Instructor accounts require an email and password. You are responsible for safeguarding your credentials and for all activity under your account. Students join sessions anonymously by code and do not create accounts.

Paid plans (Pro, Agency) are billed by subscription through Stripe. Fees are as shown at checkout, exclusive of taxes, and renew automatically until cancelled through the billing portal. Except where required by law, fees are non-refundable. Free plans are limited (currently three sessions per calendar month) and may change. Lapsed subscriptions revert to the free plan after a short grace period.

6. Your content

You retain ownership of scenarios, protocols, and other material you upload. You grant us a limited license to store, process, and display that content to operate the Service, including passing protocol text to AI providers to ground scenario generation. You represent that you have the right to upload it and that it contains no PHI or third-party confidential information you are not authorized to share.

7. Acceptable use

You will not: use the Service for real patient care; attempt to access other users' sessions, agencies, or data; reverse-engineer, scrape, or overload the Service; upload malicious content; or use the Service in violation of law. We may rate-limit, suspend, or terminate accounts that violate these Terms.

8. Intellectual property

The Service, including its waveform engine, device interfaces, scenario library, and branding, is owned by The Promotional Standard LLC. Device interfaces are original designs and are not affiliated with or endorsed by any medical-device manufacturer.

9. Availability and changes

The Service is provided "as is" and "as available." We may modify, suspend, or discontinue features, including AI features, at any time. Session data is retained on a rolling basis (see the Privacy Policy) and may be deleted without notice after the retention window.

10. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR CLINICALLY ACCURATE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PROMOTIONAL STANDARD LLC AND ITS OWNERS, CONTRACTORS, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM RELIANCE ON SIMULATED OR AI-GENERATED CONTENT, PATIENT-CARE DECISIONS, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

12. Indemnity

You will indemnify us against claims arising from your uploaded content, your violation of these Terms, or any use of the Service for patient care.

13. Governing law and disputes

These Terms are governed by the laws of the State of Colorado. Disputes will be resolved in the state or federal courts located in Adams County, Colorado, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms. Material changes will be announced in the Service or by email. Continued use after the effective date is acceptance.
